Terms & Conditions for use of the Aqua Concepts Website

  1. This website is operated by Granger Bay Paints cc t/a Aqua Concepts, also referred to as “we”, “us” or “our”.
  2. These terms and conditions (“Terms”) are applicable when you purchase any goods or services off the Granger Bay Paints cc t/a Aqua Concepts website (“Website”).
  3. “you” refers to you, our customer, who buys from us on the Website.
  4. By using the Website, you agree to be bound to these Terms.
  5. We may change these Terms from time to time, and your continued use of the Website constitutes acceptance of such amended Terms.
  6. When you purchase goods on the Website, you will have to first register and create an online profile, which includes creating a username and password. You are responsible for keeping your username and password private and secure. We will not accept any responsibility for any damage or loss that you may incur due to unauthorised use of your Website profile.
  7. By using the Website, you agree to us processing your personal information for purposes of managing and fulfilling your order.
  8. Items advertised on the Website are subject to availability. If any goods or services are not available, we will advise you of this as soon as possible.
  9. The prices indicated on the Website are in South African Rand and include value added tax. The prices are subject to change at any time and without notice to you.
  10. We will use our best efforts to display goods on the Website as accurately as possible, however cannot guarantee that the goods you receive will look the same as the goods you ordered. We reserve the right to modify the goods available on the Website from time to time, and you agree that it is your responsibility to monitor changes to our Website.
  11. Your order will be completed when we deliver the goods to you.
  12. We may reject your order in which event we will advise you of this and refund you any amount already paid by you.
  13. If you do not complete your order by paying for the goods, we will not consider your order as final and any goods in your shopping cart may no longer be available at the point you proceed to payment.
  14. We will not be held liable if goods are no longer available or if the price has changed from the time you placed your order, till the time your payment is received by us.
  15. We reserve the right to limit the sales of our goods to any person.
  16. We reserve the right to discontinue the sale of any goods at any time.
  17. We do not warrant that any goods purchased by you will meet any expectations you may have or may be fit for the purpose for which you purchased it/them.
  18. On receipt of the goods, it is your responsibility to inspect them and to advise us of any defects or damages. You must also advise us if you’ve received the wrong item(s). We will advise you of the action we will take to remedy any incorrect or defective orders. Any such defects or incorrect orders must be advised to us within 24 hours of receipt thereof.
  19. A delivery fee will be payable, and this will be advised to you at time of making your order.
  20. You are required to accept delivery of orders yourself, or if you are unable to accept the goods yourself, you must ensure that an authorised representative is available to take delivery of the order at your chosen delivery address. In such an event, we will presume that that person is authorised to accept the goods on your behalf.
  21. On delivery we will require that you or your authorised representative signs for the goods.
  22. If the goods you receive are damaged, please contact us at +27 64 173 0458 to arrange return of the goods for assessment by us.
  23. If goods are faulty or defective you may return them within 6 (six) months from the date of delivery provided they have been used for their intended purpose.
  24. We will only process any refunds due once we are in receipt of the goods.
  25. Payment for goods and delivery / courier costs must be made via electronic funds transfer into the account of Granger Bay Paints cc t/a Aqua Concepts. No goods will be couriered to you until the full payment is reflecting in our bank account.
  26. These Terms are governed by the laws of South Africa.
  27. You agree to indemnify, defend and hold harmless Granger Bay Paints cc t/a Aqua Concepts, its Members, our suppliers and employees, harmless from any claims made by any third party or arising from any breach of the Terms. You agree to pay legal fees on the scale of Attorney / own client if we have to defend our rights against you.
  28. We reserve the right to correct any errors, inaccuracies, or omissions on the Website that may relate to description of goods, prices and other related costs of your order, special offers and the availability of goods. We may also cancel your order if we discover that such an error has occurred, and such cancellation can be at any time prior to delivery of your order.
  29. You agree that your use of the Website will only be for lawful purposes and we reserve the right to restrict your right to the Website at any time for any reason whatsoever, in our sole discretion.
  30. Our Website may not always be available due to reasons of connectivity or other reasons beyond our control.
  31. Use of the Website is at your own risk.
  32. Granger Bay Paints cc t/a Aqua Concepts, its members and employees, will under no circumstances be liable for any injury, loss, claim, whether direct or indirect, and including consequential losses, suffered by you and arising from your use of the Website, any goods purchased by you from the Website, or for any claim of whatsoever nature related in any way to your use of the goods.
  33. All electronic good purchased will have specific warranty’s applicable – please refer to the product brochure on receipt thereof.
  34. All of the provisions of these terms shall be severable, and no provision shall be affected by the invalidity of any other provisions of the terms.
  35. These Terms contains the entire agreement between us, and you and we will not be bound by any undertakings, representations, warranties, promises or the like not recorded herein.
